FanDaction, Inc. ("FanDaction") is committed to ensuring the privacy of those who use the FanDaction website and mobile app ("Users"). This Privacy Policy ("Policy") describes what information is collected from Users and how that information is used and disclosed. This terms of our Privacy Policy are provided to help you make an informed decision about whether to use or continue using Fandaction. By using the FanDaction Site, you consent to the terms of this Policy.

Your use of Fandaction and any personal information you provide through our service remains subject to the terms of this Privacy Policy and our Terms of Use, as each may be updated from time to time. Be advised that any video, image, or other content you post on (e.g., your name with a comment to a blog post) is not considered personally identifiable information subject to this Privacy Policy and may be published by FanDaction.


The FanDaction Site is not intended for children under the age of 18. If you are under 18 years old please do not provide personally identifiable information of any kind on the FanDaction Site.

Types of Information Collected and How it is Collected

1.User Provided Information. You may provide to FanDaction what is generally called "personally identifiable" information if you register, such as name, email address, address, phone number and birth date. In addition, FanDaction may give you the option to provide us with certain demographic information about yourself. When you log into, our servers may automatically record certain information that your device sends whenever you visit any website and use certain apps. Such logs may include information such as your web or app request, browser type, browser language, Internet Protocol ("IP") address, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.

2.Aggregate Data. Aggregate data is data we collect about a group or category of features, services or individuals, from which individual identities have been removed. For example, information about how you use a feature may be collected and combined with information about how others use the same feature, without any personal information included in the resulting data. FanDaction uses aggregate data to help identify trends and understand member needs so we can provide better features and services. FanDaction may also share automatically collected and other aggregate non-personally-identifiable information with interested third parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the FanDaction Site.

3.Cookies. Data, such as your computer's Internet Protocol (IP) address, operating system and browser type, and the date and time of your visit, may be automatically collected through the use of "cookies" (small files that are stored on your computer by a website to give you a unique identification). Cookies also keep track of services you have used, record registration information regarding your login name and password, ensure you do not repeatedly see advertisements, record your preferences and keep you logged into the FanDaction Site. You may be able to reset your web browser to refuse all cookies or to indicate when a cookie is being sent. If you choose to do so, some features of the website may not function properly if the ability to accept cookies is turned off.

4.Third Party Collected Data. We may use, and allow third parties to use, web beacons on the FanDaction Site to monitor the effectiveness of advertising or for other legitimate purposes. Web beacons are small, graphic images on web pages, web-based documents, or in email messages that allow us or third parties to monitor who is visiting the FanDaction Site or if the email has been read. Web beacons collect the IP address of the computer that the web beacon is sent to, the URL of the page the web beacon comes from and the time it was viewed. Web beacons may be linked to your personal information. We may also use third party ad servers or network advertisers, to deliver ads to you. These third party ad servers may use cookies, web beacons or other technology to collect non-personally identifiable information about your visits to our Site in order to present advertisements that may be of interest to you.

5. Mobile App Information. When available, should you chose to use our mobile app, we also may collect mobile device information like operating system and hardware type, numbers or codes that are unique to your particular device, device state information, default device language, the location of your device, and app usage information.

How We Use Your Information

1. We use your personal information to operate, maintain, and provide to you the features and functionality of the Fandaction Site, including but not limited to the following: (a) providing you our products and services, including our games; (b) processing and responding to inquiries; (c) alerting you to new Service features, special events, products and services, or certain third-party products or services in which we think you will be interested; and (d) enforcing the legal terms that govern your use of the Service.

2. We may use your information to contact you for both marketing and non-marketing or administrative purposes.

3. We use your information to improve the quality and design of the Fandaction Site and to create new features, promotions, functionality, and services, such as by storing, tracking, and analyzing User preferences and trends.

4. We also use cookies, clear gifs, log file information and mobile app information for purposes such as (a) remembering information so that you will not have to re-enter it during your visit or the next time you visit the Fandaction Site; (b) providing custom, personalized content and information; (c) monitoring the effectiveness of our marketing campaigns; (d) monitoring aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) tracking your entries, submissions, and status in promotions, sweepstakes, and contests.

5. We may anonymize or aggregate your information for business purposes, including for reporting and research. Anonymous and/or aggregated data does not identify you, and we may use and disclose such information without limitation.

Disclosure of Information

We do not sell, rent or share personally identifiable information with third parties without your prior consent except in the limited circumstances described in this Policy. We share personally identifiable information with third party contractors who assist us in performing internal functions necessary to operate our business. These functions may include: analyzing data, providing marketing assistance and processing payment transactions. We limit the information shared with our third party contractors to information which is necessary to carry out those functions. We require that these parties agree to process such information in compliance with this Policy, we use reasonable efforts to limit their use of such information, and we require these parties to use any other appropriate confidentiality and security measures. We share automatically collected and other aggregate non-personally-identifiable information with interested third parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the FanDaction Site.

We do not share personally identifiable information with other third party organizations for their marketing, advertising or promotional use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in.

Except as stated in this Policy, we do not share personally identifiable information about Users with third parties unless we reasonably believe that doing so is legally required or is in FanDaction's interest to protect its property or other legal rights or the rights or property of others.

In addition, information about our Users, including personally identifiable information, may be disclosed as part of any merger, acquisition, debt financing or sale of FanDaction assets, as well as in the event of an insolvency, bankruptcy or receivership in which personally identifiable information could be transferred to third parties as one of our business assets.

As stated, we do not share your personal information with third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. These are provided for your convenience only, and we do not have control over the content or privacy and security practices and policies of third party sites. User Profile and Password

If you register, you can update, correct, or delete your user information and email subscription preferences at any time by going to the log-in section of the FanDaction Site though you may not edit your User name which is viewable to other users. Your registration information is accessible online only through the use of a password. To protect the confidentiality of your personal information, we recommend that you keep your password confidential.


We use reasonable security measures in an effort to prevent loss, misuse and alteration of information under our control. However, we cannot guarantee protection of all information in all cases, for example we cannot guarantee protection against interception, misappropriation, misuse, or alteration, or that your information will not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. FanDaction may post a notice on the FanDaction Site if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. Special Note to International Users

The FanDaction Site is hosted in the United States and is intended for and directed to users in the United States and Canada.. If you are a User accessing the FanDaction Site from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please note that you are transferring your personal data to the United States which does not have the same data protection laws as the EU and other regions, and by providing your personal data you permit:

- The use of your personal data for the uses identified above in accordance with the Policy

- The transfer of your personal data to the United States as indicated above
